Carter and Lupo are the worst security/law enforcement people ever. They pick and choose which crimes to enforce and whom to arrest. If the suspect is a friend, he/she goes free.

They didn't want to arrest the man cos he wasn't the one who'd done the bad thing, it was a different time line version of him that was at fault - them not wanting to punish an innocent man seems like acceptable behaviour.
